Terms of Service

These Terms of Service ("Terms") govern your access to and use of Posty ("Service"), a social media planning and scheduling platform operated by a sole trader based in Australia ("we", "us", or "our").
By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 16 years old to use the Service. By using Posty, you represent that you meet this requirement.
2. Accounts
You are responsible for maintaining the security of your account credentials. You must not share your password or allow others to access your account. You are responsible for all activity that occurs under your account.
We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used for fraudulent or abusive purposes.
3. Organisations & Workspaces
The Service allows you to create organisations and workspaces, invite team members, and assign roles. Organisation owners and administrators are responsible for managing access and permissions within their organisations.
4. Connected Social Media Accounts
You may connect third-party social media accounts to the Service for the purpose of scheduling and publishing content. By connecting an account, you:
- Authorise us to access and use the account on your behalf as necessary to provide the Service
- Represent that you have the authority to connect that account and publish content through it
- Agree that you remain responsible for all content published through connected accounts
We are not responsible for changes to third-party platform APIs or policies that may affect the Service's ability to publish content.
5. Your Content
You retain ownership of all content you create, upload, or schedule through the Service ("Your Content"). By using the Service, you grant us a limited licence to store, process, and transmit Your Content solely for the purpose of operating the Service.
You must not use the Service to create, store, or publish content that:
- Violates any applicable law or regulation
- Infringes on any third party's intellectual property rights
- Contains malware, spam, or deceptive material
- Is defamatory, harassing, or threatening
6. Payments & Subscriptions
Certain features of the Service require a paid subscription. Payments are processed by Stripe. By subscribing, you agree to pay the applicable fees and authorise us to charge your payment method on a recurring basis.
You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. We do not provide refunds for partial billing periods unless required by Australian Consumer Law.
7. Availability & Uptime
We strive to keep the Service available and reliable, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
8. Limitation of Liability
To the maximum extent permitted by Australian law, we are not liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service. This includes, without limitation, lost profits, lost data, or business interruption.
Our total liability for any claim arising from the Service is limited to the amount you paid us in the 12 months preceding the claim.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Australian Consumer Law.
9. Indemnification
You agree to indemnify and hold us harmless from any claims, losses, or damages (including legal fees) arising from your use of the Service, your violation of these Terms, or content you publish through the Service.
10. Intellectual Property
The Service, including its design, code, and branding, is owned by us and protected by intellectual property laws. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service as described herein.
11. Termination
You may delete your account at any time. We may suspend or terminate your access if you breach these Terms. Upon termination, your right to use the Service ceases immediately. We will delete your data in accordance with our Privacy Policy.
12. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of Australia. Any disputes will be resolved in the courts of Australia.
